How Sentencing Works
Sexual assault involves any touching of one’s genitals with the mouth, anus, or genitals of another, or oral, anal, or vaginal penetration with the genitals. These crimes all share lack of consent and usually also involve various other elements such as use of force, coercion, or victim incapacitation.
Sentencing for sexual assault works as follows:
- If a deadly weapon or physical force is used, you can face a life felony.
- Parents and guardians charged with the sexual assault of a minor in their care can face a felony in the first or third degree, depending on the age of the victim and the extent of the assault.
- If the victim was physically helpless, drugged, or mentally or physically handicapped or if you, the alleged offender, threatened use of force or retaliation or are a law enforcement officer, you can be charged with a first degree felony.
If you are charged with a felony in the first degree, you can face up to 30 years in state prison and / or a fine up to $10,000.
