What Florida Law Says About Sexual Battery
Sexual battery is defined and explained in Chapter 794 of the 2015 Florida Statutes. Synonymous with rape, sexual battery involves forcing an individual to engage in sexual intercourse against their will whether through actual force or by targeting an individual who is incapable of giving consent. Although this always a serious charge, it is especially serious when charged in conjunction with domestic abuse.

Penalties for Sexual Battery
As both a sexual and often violent crime, it is also one of the most severely punished, although penalties will vary depending on the circumstances of the crime.
Examples of potential penalties include:
- Someone 18 or older accused of committing sexual battery against someone 12 or younger will be charged with a capital felony punishable by the death penalty or life imprisonment without parole. If the accused is younger than 18, punishment is life imprisonment or at least 30 years of imprisonment.
- If the victim is older than 12, the minimal charge is a second-degree felony punishable by up to 15 years imprisonment; in some cases, this can be escalated to a first-degree felony punishable by up to 30 years.
