Penalties for Rape in Florida

The sad reality is that you can be arrested for rape for simply misunderstanding your partner’s willingness to engage in a sexual act.

If you are convicted of rape, you can expect to face the following penalties:

  • If you are convicted of raping a person 12 years of age or older, you will be charged with a second degree felony and can face up to 15 years in prison and / or a fine of $10,000.
  • If you are under the age of 18 and are charged with raping an individual less than 12 years of age, you can be convicted of a life felony.
  • An adult individual charged with raping an individual less than 12 years of age can be sentenced to a capital felony.
