What Florida Prosecutors Must Prove
Florida Statute § 784.021 defines aggravated assault as an assault committed with a deadly weapon without intent to kill or with intent to commit a felony. The underlying assault requires an intentional and unlawful threat by word or act, an apparent ability to carry it out, and a well-founded fear of imminent violence.
The State must prove both the underlying assault and the aggravating factor beyond a reasonable doubt. Whether an object qualifies as a deadly weapon may depend on what it was, how it was used, and the circumstances surrounding the claimed threat.
Simple assault doesn’t include the deadly weapon or felony-intent element required for aggravated assault. Aggravated battery is a separate offense involving intentional physical contact and different statutory allegations. These distinctions determine what the prosecution must establish and what the defense should investigate.
